A Woodbridge man admitted Wednesday that he sold carvings made of sperm whale ivory across state lines, federal prosecutors said. Richard Gontarek, 55, pleaded guilty in Newark Federal court to two counts of violating the Lacey Act, which prohibits falsely labeling an international shipment of fish, wildlife, including their parts or products, or plants, according to a statement from the US Attorney’s Office District of New Jersey. On Jan. 3, 2018, and on Dec. 6, 2018, Gontarek shipped a package containing a carving made from the tooth of a sperm whale to a buyer in Etter, Pennsylvania, in exchange for payment, the office said. Sperm whales do not have tusks, but do have a single set of 40–50 teeth in their lower jaws that consist almost entirely of dentine, which is considered a form of ivory, according to Science Direct. Sperm whales are listed in Appendix I to the Convention on International Trade in Endangered Species of Wild Fauna and Flora, authorities said. State law makes it illegal for anyone to possess with intent to sell ivory or any item that contains or is made from the substance, the office said. As part of his plea agreement, Gontarek agreed to pay a fine of $2,800 to the U.S. Fish and Wildlife Service Lacey Act Reward Fund.
